By accessing or using ShopGenieAI — whether via the iOS app, Android app, or website at shopgenieai.com — you agree to be bound by these Terms of Use. If you do not agree, please do not use the service.

ShopGenieAI is operated by an individual based in New Zealand. These terms are governed by New Zealand law.

ShopGenieAI is intended for users aged 13 and older. By using the app or website, you confirm that you are at least 13 years of age.

If you are under 13, please do not use ShopGenieAI. If it comes to light that a user under 13 has submitted personal information, that information will be deleted promptly.

ShopGenieAI is an AI-powered gift recommendation tool. It uses a short quiz to generate personalised gift suggestions based on your answers, and routes you to New Zealand retailers where those products may be purchased.

ShopGenieAI is a recommendation service only. It does not sell products directly, process payments, or guarantee the availability, pricing, or accuracy of any product or retailer listing.

Gift recommendations are generated by an AI model and are provided in good faith. However, ShopGenieAI does not warrant that any recommendation is:

• Currently available from the suggested retailer
• Accurately priced at the time of viewing
• The exact model, version, or variant displayed
• Suitable for any specific individual or occasion

ShopGenieAI accepts no liability for purchasing decisions made based on AI-generated recommendations. The final purchasing decision is always the user's own.

ShopGenieAI is designed to recommend everyday gifts available from New Zealand retailers. The service does not recommend, facilitate, or support the purchase of the following restricted items:

• Alcohol — including wine, beer, spirits, and liqueurs
• Firearms and weapons — including guns, ammunition, and related accessories
• Tobacco and vaping products
• Illegal or controlled substances
• Adult-only content of any kind
• Gambling products or services

ShopGenieAI is open to everyone regardless of age (subject to the 13+ requirement), gender, gender identity, sexual orientation, ethnicity, nationality, religion, or disability.

ShopGenieAI welcomes and supports users from all communities, including the LGBTQ+ community. Gift recommendations are provided equally and without discrimination to all users.

ShopGenieAI links to third-party retailer websites. These sites are independent and ShopGenieAI has no control over their content, pricing, stock levels, or privacy practices.

Clicking a "Shop This Gift" link will take you to a third-party website. ShopGenieAI is not responsible for anything that occurs on those external sites, including purchases made, data collected by those sites, or any disputes with retailers.

ShopGenieAI, including its name, logo, design, quiz flow, AI prompts, and all associated content, is the intellectual property of the operator. All rights are reserved.

ShopGenieAI may not be copied, reproduced, modified, distributed, or used commercially without express written permission from the operator.

The "Kiwi Made" branding and ShopGenieAI identity are proprietary and may not be used without permission.

To the maximum extent permitted by New Zealand law, ShopGenieAI is not liable for:

• Any loss or damage arising from reliance on AI-generated gift recommendations
• Incorrect, outdated, or unavailable product information
• Any transactions made with third-party retailers
• Service interruptions, downtime, or technical errors
• Any indirect, incidental, or consequential loss of any kind

ShopGenieAI is provided on an "as is" basis without warranties of any kind, express or implied.

When using ShopGenieAI, you agree not to:

• Attempt to manipulate, reverse-engineer, or exploit the AI recommendation system
• Use the service for any unlawful purpose
• Submit false, misleading, or offensive content through the quiz
• Attempt to access restricted content or circumvent content filters
• Use automated tools, bots, or scrapers to access the service
• Reproduce or commercially exploit any part of ShopGenieAI without permission

These Terms of Use are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from the use of ShopGenieAI will be subject to the jurisdiction of the New Zealand courts.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
